1st Class Software® 1st Class GradeBook® License Agreement

IMPORTANT:  Read this before using your copy of 1st Class GradeBook.

 

 

This document is a legal agreement between you (an individual or business/school) and 1st Class Software.  Use of the enclosed software indicates the acceptance of these terms.  As used in this License Agreement, the term “Software” means the software included on two separate diskettes and/or the software downloaded from our website.  The term “Software” does not include any software that is covered by a separate license offered or granted by a person other than the 1st Class Software website or staff of 1st Class Software.

 

IF YOU DO NOT AGREE TO THESE TERMS AND CONDITIONS RETURN, INTACT, THE SOFTWARE PACKAGE, CONTAINING THE DISKETTES, MANUAL, AND UNLOCK LETTER, ANY HOMEMADE INSTALLATION DISKS, TOGETHER WITH THE OFFICIAL EMAIL RECEIPT (PRINTED) TO 1ST CLASS SOFTWARE FOR A REFUND OF THE PURCHASE PRICE.

 

1.     PROPRIETARY RIGHTS.  The software and any accompanying documentation are the proprietary products of 1st Class Software or its licensors and are protected under national laws and international treaty provisions.  Ownership of the Software and all copies, modifications, translations, and merged portions shall at all times remain with 1st Class Software or its licensors.

 

2.     GRANT OF LICENSE and TERM.  The Software and accompanying documentation are being licensed to you; this means you have the right to use the Software only in accordance with this License Agreement.  The Software is considered in use on a computer when it is loaded into temporary memory or installed into permanent memory.

 

a.   PERSONAL LICENSE.  This license is personal to you.   You may not sub-license, lease, sell, or otherwise transfer the Software or any other accompanying documentation to any other person/teacher.    You may use the Software only for your own personal use if you are an individual, or for your own internal grading purposes.  Each personal license purchase entitles the purchaser to unlock keys so that the purchaser can have the convenience of having the gradebook in multiple locations (e.g. school, home, laptop).  A personal user license is not limited to home use.

 

b.      MULTIPLE SCHOOL/SITE LICENSES:  These licenses, purchased by purchase order, telephone, or internet are personal to your school and to the number of teachers licensed through the school.  These licenses are non-transferable from one school to another.  All licenses purchased under the name of the registered school absolutely may not be used in another school. Multiple school licenses entitles each individual teacher to two unlock keys for the convenience of having the software on both home and school computers.  If a registered school chooses to have the Software on a network, a network unlock key must be administered by the staff of 1st Class Software.  To obtain this network unlock key, contact 1st Class Software at 905-302-9988.
